1. Agreement to Terms

Welcome to Seedream AI. By accessing or using our website and AI image generation services ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Seedream AI provides a free online AI-powered image generation service. Our Service allows users to create images from text prompts using advanced artificial intelligence technology, including but not limited to:

• Text-to-image generation
• Various aspect ratio options (1:1, 9:16, 16:9, and more)
• High-resolution image outputs
• Multiple artistic styles and customization options

3. User Eligibility

You must be at least 13 years old to use this Service. By using this Service, you represent and warrant that you are at least 13 years of age. If you are under 18, you confirm that you have obtained parental or guardian consent to use this Service.

4. User Accounts and Registration

Currently, Seedream AI does not require user registration or account creation. Our Service is available for immediate use without sign-up. However, we reserve the right to implement user accounts in the future.

We use Cloudflare Turnstile for human verification to prevent automated abuse of our Service.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use our Service to:

• Generate images for personal or commercial projects
• Create artwork, illustrations, and visual content
• Experiment with AI image generation technology
• Download and use generated images subject to our license terms

5.2 Prohibited Uses

You agree NOT to use our Service to:

• Generate illegal, harmful, violent, or abusive content
• Create images that infringe on others' intellectual property rights
• Generate explicit adult content or child exploitation material
• Create misleading deepfakes or impersonate real individuals without consent
• Harass, abuse, or harm another person
• Violate any applicable laws or regulations
• Attempt to bypass rate limits or security measures
• Use automated tools, bots, or scripts to abuse the Service
• Reverse engineer or attempt to extract the underlying AI models
• Resell or redistribute our Service without authorization

6. Rate Limits and Usage Restrictions

To ensure fair access for all users, we implement rate limits on our Service:

• Daily Limit: 5 free image generations per day per user/IP address
• Rate limits reset every 24 hours
• We reserve the right to adjust these limits at any time
• Attempting to circumvent rate limits may result in service suspension

7. Intellectual Property Rights

7.1 Ownership of Generated Images

For images you generate using our Service:

• You retain ownership rights to images you create with unique text prompts
• Images are generated using AI models and may contain elements derived from training data
• Similar or identical images may be generated by other users using similar prompts
• We do not claim ownership of your generated images

7.2 License to Use Generated Images

Subject to compliance with these Terms, you are granted a license to use images generated through our Service for:

• Personal use
• Commercial use
• Modification and derivative works

The Service, including its original content, features, functionality, website design, code, and branding (excluding generated images), is owned by Seedream AI and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. User-Generated Content and Prompts

By submitting text prompts or any other content to our Service, you grant us:

• The right to process your prompts to generate images
• The right to use aggregated, anonymized data for service improvement
• The right to analyze usage patterns for security and quality purposes

You represent and warrant that:

• You have the right to submit the content you provide
• Your content does not violate any third-party rights
• Your content complies with our Acceptable Use Policy

9. Disclaimer of Warranties

IMPORTANT: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express or implied.

We do not warrant that:

• The Service will function uninterrupted, secure, or error-free
• Generated images will meet your specific requirements or expectations
• Any errors in the Service will be corrected
• The Service will be available at any particular time or location
• Results will be accurate, reliable, or free from defects

AI-generated images may contain inaccuracies, artifacts, or unexpected results. You are solely responsible for evaluating the suitability of generated images for your purposes.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Seedream AI, its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your access to or inability to access the Service
• Damages from any content generated through the Service
• Unauthorized access to or alteration of your transmissions or data
• Any third-party conduct or content on the Service

In no event shall our total liability exceed the amount you paid us in the past twelve months, or $100, whichever is greater.

11. Indemnification

You agree to defend, indemnify, and hold harmless Seedream AI and its licensors, employees, contractors, agents, officers, and directors from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit or generate using the Service

12. Third-Party Services

Our Service may contain links to third-party websites or services, including:

• Cloudflare (CDN and security)
• Google AdSense (advertising)
• Analytics providers
• AI model providers

We are not responsible for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be liable for any damages or losses caused by your use of such third-party content or services.

13. Service Modifications and Termination

We reserve the right to:

• Modify or discontinue the Service (or any part thereof) at any time
• Change these Terms at our sole discretion
• Suspend or terminate your access to the Service for violations of these Terms
• Introduce paid features or subscription tiers in the future

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
